
Owning in Mexico
It is a common misconception that foreigners cannot own real estate
in Mexico, but the reality is that they can. Changes in Mexican
law, including NAFTA in 1994 and the Foreign Investment Law of
1993, now allow Americans and other foreigners to own real estate.
A renewable 50 year bank trust (Fideicomiso) is created with you,
the foreigner owner, as the beneficiary. You can live on the property,
sell it whenever you want, or pass it on to your heirs. The bank
trust is renewed every 50 years, meaning you and your heirs own
the property until you decide to sell. Bank trusts are used to
guarantee the owners (beneficiary) of the trust absolute control
over their assets, and the trust arrangement does not limit your
rights to the property in any way. The Fideicomiso has been established
as a secure form of ownership and has facilitated billions of dollars
worth of property transactions.
Title Insurance
A good rule to follow when purchasing real estate in Mexico is:
If you can't get title insurance... then don't buy!
Title Insurance for the complete
Boca de Iguanas development is provided by Stewart Title Company.
A title insurance policy provides a financially backed guaranty
and ensures the property against fraud, liens, encumbrances or
improperly executed documents, and ultimately allows for US based
financing of your residence.
Although the complete project has insured
title, each individual house/condo can also receive individual
title insurance through Stewart Title for a one-time fee around
$3,000 USD.
The bilingual professionals at Stewart Title are also providing
the escrow and closing coordination services for the residences
at Boca de Iguanas.
Homeowners Association
Owners are assured of continuing quality and maintenance through
an Annual Assessment fee, which pays for the professional management
and operation of all Residence facilities and amenities. Included
in these annual fees are funds for maintenance, insurance, refuse
removal, legal and accounting services, staff salaries, supplies,
and a pro-rata provision for the replacement and refurbishing
of BDI facilities.
A member-elected Board of Directors establishes budgets and fees
on an annual basis. During the early development years, and throughout
the developer’s subsidy period, representation on the Board
will include primarily Boca de Iguanas management personnel.

We'll also arrange for chef, spa, and wedding planning
services, entertainment for your special events, flowers, cribs,

Vacation Rental Program*
Our optional vacation rental program generates revenue when you
are not using your house or condo by leveraging the services and
amenities of the BDI Hotel, offering guests a unique and affordable
vacation experience in an intimate, home-away-from-home tropical
beach setting.
All residences participating in the rental program will be inspected
for quality control, standards and maintenance on a regular basis.
Once you enter in the vacation
rental program, our property management team takes over, ensuring
all aspects of operations – from
maintenance and guest needs to repairs and reservations – are
met and that condos and houses are left in spotless, top-notch
condition. Home owners have the peace of mind knowing their properties
are well-cared for while they are away.
The catch? There is none. Your home creates
lasting memories for others – and cash flow for you, the
owner – while
you and your family are away.

Construction Schedule
In order to provide a relaxing beach lifestyle, major construction
will only be allowed in the low-season months (May - November).
As such, home owners and hotel guests can enjoy the development
during the estimated 3-4 years until completion.
Minor construction
and interior details as well as reparation work can be completed
during high-season given they comply with noise by-laws and receive
the approval of the Homeowners Association.
Residences can be built
entirely in approximately 6 months, upon contract and deposit. Please
